Aggressive Defense to Move Your DUI Case in the Right Direction

We take a hard look at the evidence and develop an effective strategy for challenging three elements of the DUI offense:

  1. The Stop: We examine the reason that the police officer had for stopping your car. To make a legal traffic stop, the officer must have a reasonable and articulable suspicion that you were guilty of drunk driving. If the officer lacks this reasonable suspicion, we can try to get the evidence from your stop suppressed, which often results in the DUI charge being dropped.

  2. The Arrest: We look at how the officer determined that there was probable cause to make a DUI arrest. Officers often direct suspected drunk drivers to perform field sobriety tests, such as the one-leg stand or the walk-and-turn, to determine if they are intoxicated. You do no have to perform filed sobriety tests, such as the walk-and-turn test. If you refuse a breath test or blood test, however, you will likely be arrested and charged with both DUI and refusal. We can challenge the DUI arrest due to lack of evidence and lack of probable cause if you refused to perform the tests.

  3. The Scientific Evidence: We are familiar with both the science and the law of tests for blood alcohol content (BAC). If you did perform a field sobriety and breath test and failed, we can challenge the validity of the Breathalyzer test results. An attorney experienced with DUI defense cases will know how these machines work and how to challenge this evidence. The prosecution must prove that the machine was properly calibrated and that the officer had sufficient training to yield accurate results.

In each DUI case, we challenge the officer's probable cause. Our goal is to get you the best result possible given the facts. Our firm skillfully assists clients who are facing DUI charges and have prior DUI offenses. We also represent clients who are accused of reckless driving, who were allegedly driving on a license suspended due to DUI, and who may lose their drivers licenses due to administrative penalties.
